Fort Worth Traffic Violations

It is more difficult to have your speeding ticket dismissed in Fort Worth than it is in Dallas. In Fort Worth, there is a two step process to resolving all traffic tickets. First there is a pre-trial docket where the officer must show up and validate the ticket. If there are any serious mistakes or the officer doesn't show, the case may be dismissed. If you have a CDL, you should take any chance you can get to pursue dismissal of your traffic ticket.

The second step takes place if your case is not dismissed, it will be set on an Attorney Plea Docket. On that date, you do not need to appear with me, but I will go to court on your behalf and I will negotiate the best deal I can with the prosecuting attorney. In most cases, I can get you a deferred adjudication probation, which will keep the citation off your driving record.

You do not want to be issued a ticket for a traffic violation when there is already an outstanding warrant in your name regarding a previous violation. There are two separate kinds of warrants issued by the state of Texas, and with over a decade of experience as a traffic attorney:

According to officials cited in The Dallas Morning News report, many people fail to pay traffic citations because they do not know their options. Many assume the only option is to plead guilty and pay. Some will attempt to avoid paying the fines indefinitely and try to avoid arrest. But the same officials also warn that if arrested during the round up, offenders usually only have two options - pay the fine or go to jail. Law enforcement officials urge people with Dallas warrants to take care of the situation proactively, citing the opportunity to negotiate and deal with prosecutors.

If you have or suspect you have an outstanding Dallas warrant, getting help is crucial. The first step, however, is to make sure that your case never gets that far. If you have received a traffic citation, it is important not to ignore the Dallas ticket or hope that it will go away on its own. Failing to pay or fight the fine can have serious consequences. An experienced traffic defense attorney can help explain your options.

MARCH IS DALLAS & FORT WORTH WARRANT ROUND UP MONTH

Every March, law enforcement officials from around Texas participate in the annual Statewide Warrant Roundup. The Dallas & Fort Worth roundups focuses on finding and arresting those with outstanding warrants and collecting the millions of dollars in unpaid fines. Though the roundup usually takes place in the spring, others occur in various counties throughout the year. This past August, marshals from Dallas and the surrounding communities conducted another roundup, going after the $99 million in uncollected fines from over 130,000 individuals.

As the annual Dallas roundup is here, it is important to take care of Dallas traffic citations and warrants before the police find you.

Alias Warrant: Did you fail to respond to your Fort Worth traffic ticket? If so, the ticket expired and now there is an alias warrant in your name. You still have the right to appear in court. I will post your bond, remove your warrant, and set a new court date.

Capias Warrant: If you already had your hearing, but you failed to comply with the orders of the Fort Worth municipal court, then they issued a capias warrant. You have two options: pay the fine or go to jail.

Traffic Warrants

Even the smallest traffic violations can result in a warrant, if you fail to take care of your Fort Worth ticket or comply with court orders. Do not underestimate the importance of taking care of your traffic violation:

Speeding tickets
Driving without a license (No DL)
Driving while license suspended (DWLS)
Running a red light or stop sign (DTCD)
Failure to Maintain Financial Responsibility (FMFR)
No Insurance
No registration or expired registration (MVR)
No inspection or expired inspection (MVI)
Reckless driving
Failure to appear (FTA)
Violation of promise to appear (VPTA)
Failure to signal
Failure to maintain a single lane

There are potential consequences for a speeding ticket in Texas. You may be subject to fines, surcharges and higher insurance rates. Luckily, you have options, and the sooner you call an experienced lawyer, the sooner you will know what to expect. I can represent you at your hearing, so you don't have to be there. I know the different ways to get you the best settlement possible:

Defensive Driving School: Driving school will cost you both time and money, but depending on the severity of your traffic ticket, this may be your best option for keeping your license clean and reducing your fines.

Deferred Adjudication: In most cases, I can work out a deal for deferred adjudication, which is essentially a probationary period. This way you can pay the court without being found guilty, which will allow you to keep your record clean.

CDL Traffic Violations

The severity of a speeding ticket for a driver with a commercial driver's license is much greater. I can help you fight to keep the ticket off your record and keep your license. When your livelihood is at stake, contact an attorney with over a decade of experience defending truckers.

Speeding tickets that are more than fifteen miles per hour over the speed limit are very serious. If your offense is fourteen miles per hour over the limit or less, you face much more benign consequences. Offenses less then ten percent over the speed limit do not even carry point penalties. Whatever your initial offense was, I will work to have it reduced to the smallest charge possible.

Dallas Municipal Traffic Violations

If you follow my instructions, I can help you try to get your Dallas traffic ticket dismissed. The first thing I will do is send a notice to the court, in order to set a court date, which will usually follow in about six months. More often than not, Dallas police officers do not show up for these cases, and so they are completely dismissed. However, in order to have your case dismissed, you must attend the hearing with me to get it dismissed. If you cannot appear in court with me, in most cases, I can keep the citation off your record but you will have to pay a probation fee to the city.

The challenges in the court system facing drivers with a CDL are much greater than those facing people with standard licenses. There are fewer options for case dismissals and it is harder, but not impossible, to reduce or fight to reduce the points. Contact me to learn about your options.

Grounds for dismissal: The first thing I will do is pursue all possible grounds for dismissal. If such grounds exist, you will have all charges thrown out with no further consequences.

Keeping citations off your record: If the charges are legitimate, I will work to reach a settlement where the charges are not on your driving record.

Minimizing the damage: Even when the citation goes on your record, I will work to reduce the points and keep them as low as possible.

Going to trial: If you are willing to pursue litigation in order to fight for your rights, I will represent you strongly in trial.

Out-of-State Truckers

If you've been ticketed for a moving violation or equipment violation while driving through Texas, your CDL may be in jeopardy. Do you want to avoid points on your record, but you are unsure how you can do that from thousands of miles away?
